ข้อกำหนดฉบับนี้เป็นสัญญาระหว่างคุณกับ บริษัท มูเทค เดสตินี่ จำกัด (“บริษัท” “เรา”) ว่าด้วยการใช้เว็บไซต์ mumate.co แอปพลิเคชัน Mumate เครื่องมือผูกดวง bazichart.mumate.co บัญชี LINE Official Account @mumate.co และช่องทางจำหน่ายอื่นของ Mumate (รวมเรียกว่า “บริการ”)

การเข้าใช้บริการถือว่าคุณได้อ่าน เข้าใจ และยอมรับข้อกำหนดนี้แล้ว หากคุณไม่ยอมรับ กรุณาหยุดใช้บริการ

1. ลักษณะของบริการและข้อสงวนสิทธิ์สำคัญ

บริการของเราครอบคลุมการคำนวณผังดวงจีน (ปาจื้อ) การจัดทำคำทำนายและหนังสือดวงเฉพาะบุคคล คอร์สเรียนดูดวง บริการปรึกษากับซินแส และสินค้าดิจิทัลอื่น ๆ โปรดอ่าน คำสงวนสิทธิ์ (Disclaimer) ประกอบด้วย

2. คุณสมบัติของผู้ใช้บริการ

• คุณต้องมีอายุอย่างน้อย 13 ปีบริบูรณ์จึงจะใช้บริการได้
• ผู้ที่มีอายุต่ำกว่า 20 ปี ต้องได้รับความยินยอมจากผู้ปกครองก่อนสมัครใช้บริการหรือชำระเงิน
• คุณรับรองว่าข้อมูลที่ให้แก่เราถูกต้อง ครบถ้วน และเป็นปัจจุบัน

3. บัญชีผู้ใช้

• คุณอาจสมัครบัญชีโดยตรง หรือเข้าสู่ระบบด้วย Facebook Login หรือช่องทางอื่นที่เรารองรับ
• คุณมีหน้าที่รักษาความลับของข้อมูลเข้าสู่ระบบ และรับผิดชอบต่อกิจกรรมทั้งหมดที่เกิดขึ้นภายใต้บัญชีของคุณ
• หากพบการเข้าถึงบัญชีโดยไม่ได้รับอนุญาต กรุณาแจ้งเราทันที
• ห้ามโอน ขาย หรือให้ผู้อื่นใช้บัญชีของคุณ

4. ความถูกต้องของข้อมูลวันเวลาเกิด

ความแม่นยำของผังดวงขึ้นอยู่กับความถูกต้องของวัน เดือน ปีเกิด เวลาเกิด และสถานที่เกิดที่คุณกรอก หากข้อมูลคลาดเคลื่อน ผลการคำนวณย่อมคลาดเคลื่อนตาม บริษัทไม่รับผิดชอบต่อผลที่เกิดจากข้อมูลที่คุณกรอกไม่ถูกต้อง และการกรอกข้อมูลผิดพลาดไม่ถือเป็นเหตุในการขอคืนเงิน

5. ราคา การชำระเงิน และภาษี

• ราคาสินค้าและบริการแสดงเป็นเงินบาทไทย (THB) และรวมภาษีตามที่กฎหมายกำหนดแล้ว
• ปัจจุบันบริษัทไม่ได้จดทะเบียนภาษีมูลค่าเพิ่ม จึงออกใบเสร็จรับเงิน ไม่ใช่ใบกำกับภาษี
• ช่องทางชำระเงินที่รองรับ ได้แก่ บัตรเครดิต/เดบิต (ผ่านผู้ให้บริการรับชำระเงินที่ได้มาตรฐาน PCI-DSS) PromptPay การโอนเงินผ่านธนาคาร และช่องทางร้านค้าออนไลน์ที่เราประกาศไว้
• เราขอสงวนสิทธิ์ในการเปลี่ยนแปลงราคาและเงื่อนไขโปรโมชันโดยไม่ต้องแจ้งล่วงหน้า ทั้งนี้ไม่กระทบคำสั่งซื้อที่ชำระเงินสมบูรณ์แล้ว

6. การส่งมอบ การยกเลิก และการคืนเงิน

6.1 การส่งมอบ

สินค้าดิจิทัล (เช่น PDF ไหว้องค์เทพ คอร์สเรียน วอลเปเปอร์) จะส่งมอบผ่านช่องทางออนไลน์ภายในเวลาที่ระบุในหน้าสินค้า สำหรับหนังสือดวงเฉพาะบุคคลและบริการดูดวงกับซินแส ระยะเวลาจัดทำจะแจ้งให้ทราบเมื่อยืนยันคำสั่งซื้อ

6.2 การคืนเงิน

• สินค้าดิจิทัลที่ดาวน์โหลด/เข้าถึงเนื้อหาแล้ว ไม่สามารถขอคืนเงินได้ เว้นแต่ไฟล์เสียหายหรือส่งมอบไม่ครบ
• งานที่จัดทำเฉพาะบุคคล (หนังสือดวง คำทำนายรายบุคคล) ยกเลิกและขอคืนเงินได้ก่อนที่เราจะเริ่มจัดทำเท่านั้น
• บริการปรึกษากับซินแส เลื่อนหรือยกเลิกได้โดยแจ้งล่วงหน้าอย่างน้อย 24 ชั่วโมงก่อนเวลานัดหมาย หากไม่มาตามนัดโดยไม่แจ้งล่วงหน้า ถือว่าสละสิทธิ์และไม่คืนเงิน
• ความไม่พอใจในเนื้อหาคำทำนาย ไม่ถือเป็นเหตุในการขอคืนเงิน เนื่องจากเป็นบริการเชิงความเชื่อและการตีความ
• กรณีเราไม่สามารถส่งมอบบริการได้ เราจะคืนเงินเต็มจำนวนภายใน 14 วันทำการ

7. ทรัพย์สินทางปัญญา

• เนื้อหา ระบบคำนวณ ตำรา บทความ ภาพ กราฟิก โลโก้ และซอฟต์แวร์ทั้งหมดในบริการ เป็นทรัพย์สินทางปัญญาของบริษัทหรือผู้อนุญาตให้ใช้สิทธิ
• เมื่อคุณซื้อสินค้าดิจิทัล คุณได้รับสิทธิใช้งานส่วนบุคคล ไม่ผูกขาด และโอนสิทธิ์ต่อไม่ได้ เพื่อการใช้ส่วนตัวเท่านั้น
• ห้ามทำซ้ำ ดัดแปลง เผยแพร่ต่อ จำหน่ายต่อ แจกจ่าย หรือใช้เพื่อการค้าหรือการสอนต่อ โดยไม่ได้รับอนุญาตเป็นลายลักษณ์อักษรจากบริษัท
• เนื้อหาที่คุณส่งเข้ามา (เช่น รีวิว ความคิดเห็น) ยังเป็นของคุณ แต่คุณอนุญาตให้บริษัทใช้ ทำซ้ำ และเผยแพร่เพื่อการประชาสัมพันธ์บริการได้โดยไม่มีค่าตอบแทน

8. ข้อห้ามในการใช้บริการ

คุณตกลงจะไม่:

• ใช้บริการเพื่อการใด ๆ ที่ผิดกฎหมาย หลอกลวง หรือละเมิดสิทธิผู้อื่น
• คัดลอก ดึงข้อมูลอัตโนมัติ (scraping) เจาะระบบ หรือพยายามเข้าถึงส่วนที่ไม่ได้รับอนุญาต
• ทำวิศวกรรมย้อนกลับ แยกส่วน หรือพยายามเข้าถึงซอร์สโค้ดของระบบ
• นำคำทำนายหรือระบบของเราไปให้บริการต่อในเชิงพาณิชย์โดยไม่ได้รับอนุญาต
• ส่งข้อความข่มขู่ คุกคาม ลามกอนาจาร หรือสร้างความเสียหายแก่ผู้อื่นผ่านช่องทางของเรา
• ปลอมแปลงตัวตนหรือใช้ข้อมูลบุคคลอื่นโดยไม่ได้รับความยินยอม

เราขอสงวนสิทธิ์ระงับหรือยกเลิกบัญชีที่ฝ่าฝืนได้ทันที โดยไม่คืนเงินค่าบริการคงเหลือ

9. บริการของบุคคลที่สาม

บริการอาจเชื่อมต่อกับแพลตฟอร์มภายนอก เช่น Facebook/Meta, LINE, Google, ผู้ให้บริการรับชำระเงิน และผู้ให้บริการปัญญาประดิษฐ์ การใช้งานส่วนที่เป็นของบุคคลที่สามอยู่ภายใต้ข้อกำหนดและนโยบายของผู้ให้บริการรายนั้น บริษัทไม่รับผิดชอบต่อการทำงาน ความพร้อมใช้งาน หรือเนื้อหาของบริการภายนอก

10. ความพร้อมใช้งานของบริการ

เราพยายามให้บริการอย่างต่อเนื่อง แต่ไม่รับประกันว่าบริการจะปราศจากข้อผิดพลาดหรือหยุดชะงัก เราอาจปรับปรุง ระงับ หรือยุติบางส่วนของบริการได้ โดยจะแจ้งล่วงหน้าตามสมควรหากเป็นการเปลี่ยนแปลงในสาระสำคัญ

11. ข้อจำกัดความรับผิด

ภายในขอบเขตสูงสุดที่กฎหมายอนุญาต:

• บริษัทไม่รับผิดต่อความเสียหายทางอ้อม ความเสียหายสืบเนื่อง การสูญเสียโอกาส กำไร ชื่อเสียง หรือข้อมูล ที่เกิดจากการใช้หรือไม่สามารถใช้บริการได้
• บริษัทไม่รับผิดต่อการตัดสินใจใด ๆ ของคุณที่กระทำโดยอาศัยคำทำนายหรือเนื้อหาในบริการ
• ความรับผิดรวมของบริษัทต่อคุณในทุกกรณี จะไม่เกินจำนวนเงินที่คุณชำระให้บริษัทสำหรับบริการที่เป็นเหตุแห่งข้อพิพาทในช่วง 6 เดือนก่อนเกิดเหตุ

ข้อจำกัดนี้ไม่ตัดสิทธิของผู้บริโภคที่กฎหมายไทยกำหนดไว้ และไม่ใช้บังคับกับความรับผิดที่เกิดจากการฉ้อฉลหรือความประมาทเลินเล่ออย่างร้ายแรงของบริษัท

12. การชดใช้ค่าเสียหาย

คุณตกลงชดใช้และปกป้องบริษัทจากข้อเรียกร้อง ความเสียหาย และค่าใช้จ่าย (รวมถึงค่าทนายความตามสมควร) อันเกิดจากการที่คุณฝ่าฝืนข้อกำหนดนี้ ละเมิดกฎหมาย หรือละเมิดสิทธิของบุคคลอื่น

13. ข้อมูลส่วนบุคคล

การเก็บรวบรวมและใช้ข้อมูลส่วนบุคคลของคุณเป็นไปตาม นโยบายความเป็นส่วนตัว ซึ่งถือเป็นส่วนหนึ่งของข้อกำหนดฉบับนี้ หากต้องการลบข้อมูล ดูขั้นตอนที่หน้า คำแนะนำการลบข้อมูล

14. การแก้ไขข้อกำหนด

เราอาจแก้ไขข้อกำหนดนี้เป็นครั้งคราว โดยประกาศฉบับล่าสุดบนหน้านี้พร้อมวันที่มีผลบังคับใช้ หากเป็นการเปลี่ยนแปลงในสาระสำคัญ เราจะแจ้งล่วงหน้าอย่างน้อย 7 วันผ่านอีเมลหรือประกาศในบริการ การใช้บริการต่อไปหลังวันที่มีผลบังคับใช้ถือว่าคุณยอมรับข้อกำหนดฉบับใหม่

15. กฎหมายที่ใช้บังคับและเขตอำนาจศาล

ข้อกำหนดนี้อยู่ภายใต้บังคับของกฎหมายไทย ข้อพิพาทใด ๆ ให้อยู่ในเขตอำนาจของศาลไทย ทั้งนี้ คู่สัญญาตกลงจะพยายามเจรจาหาข้อยุติโดยสุจริตก่อนดำเนินคดี

Terms of Service

English version — Mumate

These Terms form an agreement between you and Mootech Destiny Co., Ltd. (“we”, “us”) governing your use of mumate.co, the Mumate application, bazichart.mumate.co, our LINE Official Account @mumate.co and our other sales channels (the “Service”). By using the Service you confirm that you have read, understood and accepted these Terms. If you do not accept them, please stop using the Service.

1. Nature of the Service — important notice

Our Service includes Chinese astrology (BaZi) chart calculation, readings and personalised destiny books, astrology courses, consultations with practitioners, and other digital products. Please also read our Disclaimer.

2. Eligibility

• You must be at least 13 years old to use the Service.
• Users under 20 require parental or guardian consent before registering or making a purchase.
• You confirm that the information you provide is accurate, complete and current.

3. Accounts

• You may register directly or sign in with Facebook Login or another supported provider.
• You are responsible for keeping your credentials confidential and for all activity under your account.
• Notify us immediately of any unauthorised access.
• You may not transfer, sell or share your account.

4. Accuracy of birth details

The accuracy of a chart depends entirely on the birth date, time and place you supply. Incorrect input produces an incorrect chart. We are not liable for outcomes caused by inaccurate information you provide, and incorrect input is not a ground for a refund.

5. Pricing, payment and tax

• Prices are shown in Thai Baht (THB) and include applicable taxes.
• We are not VAT-registered, so we issue receipts, not tax invoices.
• Accepted payment methods include credit/debit card (via PCI-DSS compliant processors), PromptPay, bank transfer, and the online storefronts we announce.
• We may change prices and promotional terms without prior notice; changes do not affect orders already paid in full.

6. Delivery, cancellation and refunds

6.1 Delivery

Digital products (PDF guides, courses, wallpapers) are delivered online within the timeframe stated on the product page. For personalised destiny books and practitioner consultations, the preparation time is confirmed when your order is accepted.

6.2 Refunds

• Digital products already downloaded or accessed are non-refundable, unless the file is corrupt or incomplete.
• Personalised work (destiny books, individual readings) may be cancelled and refunded only before we begin preparation.
• Practitioner consultations may be rescheduled or cancelled with at least 24 hours’ notice. No-shows without notice forfeit the session and are non-refundable.
• Dissatisfaction with the content of a reading is not a ground for refund, as this is an interpretive, belief-based service.
• If we are unable to deliver, we refund in full within 14 business days.

7. Intellectual property

• All content, calculation systems, texts, articles, images, graphics, logos and software in the Service are the intellectual property of the company or its licensors.
• Purchasing a digital product grants you a personal, non-exclusive, non-transferable licence for private use only.
• You may not reproduce, adapt, republish, resell, distribute, or use the content commercially or for teaching without our prior written permission.
• Content you submit (reviews, comments) remains yours, but you grant us a royalty-free licence to use, reproduce and publish it to promote the Service.

8. Prohibited conduct

You agree not to: use the Service for unlawful, deceptive or rights-infringing purposes; copy, scrape, hack or attempt unauthorised access; reverse engineer or decompile the system; resell or white-label our readings or system without permission; send threatening, harassing or obscene content through our channels; or impersonate others or use another person’s data without consent. We may suspend or terminate offending accounts immediately, without refund of any remaining balance.

9. Third-party services

The Service integrates with external platforms including Facebook/Meta, LINE, Google, payment processors and AI providers. Your use of those components is governed by the respective provider’s terms. We are not responsible for the operation, availability or content of third-party services.

10. Availability

We aim to provide continuous service but do not warrant that it will be uninterrupted or error-free. We may modify, suspend or discontinue parts of the Service, giving reasonable prior notice for material changes.

11. Limitation of liability

To the fullest extent permitted by law: we are not liable for indirect or consequential loss, or loss of opportunity, profit, reputation or data arising from your use of or inability to use the Service; we are not liable for decisions you make in reliance on any reading or content; and our aggregate liability to you will not exceed the amount you paid us for the service giving rise to the claim in the six months preceding the event. Nothing here excludes consumer rights guaranteed under Thai law, or liability arising from our fraud or gross negligence.

12. Indemnity

You agree to indemnify and hold us harmless from claims, damages and costs (including reasonable legal fees) arising from your breach of these Terms, violation of law, or infringement of a third party’s rights.

13. Personal data

Our collection and use of your personal data is governed by our Privacy Policy, which forms part of these Terms. To delete your data, see the Data Deletion page.

14. Changes to these Terms

We may amend these Terms from time to time and will publish the current version on this page with its effective date. For material changes we will give at least 7 days’ notice by email or in-service announcement. Continuing to use the Service after the effective date constitutes acceptance.

15. Governing law and jurisdiction

These Terms are governed by the laws of Thailand, and disputes fall under the jurisdiction of the Thai courts. The parties agree to attempt good-faith negotiation before commencing proceedings.
